1. Autolink AI Tech Terms & Conditions

Autolink AI Tech for digital brokerage is a limited liability company, registered with no.

----------------- in the commercial register, and a unified no. ------------. The following terms and conditions have been set to provide clear guidelines and binding terms and conditions regarding the services provided by "Autolink AI Tech "to the customer and are subject to the supervision and control of the Saudi Central Bank. The company operates under the trademark "Autolink AI Tech ", hereinafter referred to as "Autolink AI Tech ", "we", "us", or "the Company". These Terms govern the use of the Autolink AI Tech App for digital brokerage services and the Autolink AI Tech website and define the client's relationship with the company, as well as any other services provided through the Autolink AI Tech App from time to time. This agreement is available in Arabic and English.

Terms (hereinafter referred to as "Registration") are provided to the customer for review and acceptance before granting consent and approval to complete the onboarding and registration process in the platform. Registration is a prerequisite for using the Autolink AI Tech platform as well as the services. Registration requires "Know Your Customer"("KYC") procedures in order to verify the customer's eligibility as an authorized user of the services upon acceptance of these Terms.

The terms in this agreement affect the obligations and rights in accordance with the laws of the Kingdom of Saudi Arabia, so please read these terms carefully before completing the registration. If you do not agree to these terms, please refrain from using the Autolink AI Tech website or the Autolink AI Tech platform.

By registering for Autolink AI Tech Platform Services, you acknowledge that you have read, understood, and consented to abide by these Terms.

2. Definitions

The terms listed below shall have the meanings assigned to each of them, unless the context otherwise requires:

"Account"refers to the electronic account created by the customer through Autolink AI Tech platform for accessing services, subsequent to registration and acceptance of the terms and conditions provided by Autolink AI Tech.

"Customer"It refers, in this agreement, to any Natural Person or Legal Entity who registers or uses the services of Autolink AI Tech.

"Credentials"refers to the unique username and PIN code utilized by the Customer for accessing the Autolink AI Tech Platform.

"SAMA"refers the Saudi Central Bank.

“SIMAH”refers to the Saudi Credit Bureau.

"Autolink AI Tech Platform Customer Service Center "refers to customer care service, which is a customer service center through which customers can communicate with customer service representatives during official working hours to report any technical issues encountered while using Autolink AI Tech platform. This allows Autolink AI Tech to respond to such issues or handle any other inquiries from customers (Using info@-------------.com.sa email or calling ----------------, chat which allows Autolink AI Tech Digital Brokerage to respond to these issues or address any other customer queries).

"Digital Brokerage"refers to linking the customer with financial entities based on their creditworthiness and financial viability.

“Financier”refers to the financial institutions or entities (Banks, finance companies, and entities licensed to engage in finance activities under the laws applicable in Saudi Arabia.) that provide financing to our clients through our platform. The selection of financing partners is based on established partnerships and agreements.

“KYC”refers to the “Know-Your-Customer”process and the personal identification details of a customer, which are authenticated as per the regulations of SAMA and other government entities.

“Money Laundering”refers to all activities prohibited in accordance with the Anti-Money Laundering laws and regulations in the Kingdom of Saudi Arabia.

“PIN Code”refers to the 4-digit personal identification number chosen by the Customer to secure their Account.

“Registration”refers to the registration process which the Customer must complete in order to utilize the Autolink AI Tech Service.

"SAR"refers to Saudi Arabian Riyals.

“Autolink AI Tech Platform”is a digital platform provided by "Autolink AI Tech ", enabling registered customers to access financing offers from diverse financing entities within the Kingdom of Saudi Arabia, and according to the Autolink AI Tech license issued by SAMA.

"Autolink AI Tech Trademark"is the trademark of Autolink AI Tech for digital brokerage, specialized in providing digital brokerage services in finance, and authorized by the Saudi Central Bank.

"OTP"refers to the 4-digit security code number issued to the customer during the registration process in the "Autolink AI Tech "platform to authenticate the customer's account.

“Blacklist”A list issued by “SIMAH”of people in default on a debt.

3. Autolink AI Tech Registration and Requirements

Registration for the Autolink AI Tech Services can be completed through the registration process in the Autolink AI Tech Platform.

The completion of “KYC”procedures and verification of the customer’s identity in accordance with SAMA regulations are mandated for registration for Autolink AI Tech Services.

Autolink AI Tech retains the right, at any time, to undertake all relevant steps and procedures necessary to ensure adherence to all relevant and applicable KYC requirements set forth by SAMA.

The Customer acknowledges that all information provided is correct, complete, and accurate.

Autolink AI Tech retains the right to reject a registration request at any time if there are any discrepancies or inaccuracies in the information or documentation provided by the customer.

As part of the Registration process, the Customer will receive the OTP from ABSHER which must be inserted into Autolink AI Tech Platform to validate the Customer’s data and mobile. The customer must accept these Terms and Conditions in order to activate the Account. The Customer must create the PIN Code to login to the Autolink AI Tech Platform. The Customer can change the PIN Code at any time.

In the event that the information provided by the customer is incorrect, erroneous or misleading, the customer is solely responsible for the accuracy of the information provided during registration in the "Autolink AI Tech "platform.

Autolink AI Tech assumes no responsibility or liability for any consequences that may result from providing inaccurate, erroneous or misleading information.

If the customer has actual or constructive knowledge regarding the inaccuracy of the information provided about his Account, the customer must notify Autolink AI Tech via info@--------------.com.sa or call ------------ and the available resources provided in Autolink AI Tech platform.

If Autolink AI Tech discovers that the information provided by the customer is incorrect or misleading, Autolink AI Tech reserves the right to terminate the customer's account immediately, with or without notice. Termination of the customer's account shall be effective immediately or as specified in the notice issued by Autolink AI Tech and termination of the customer's account shall include disabling the customer's access to the Autolink AI Tech platform.

4. Autolink AI Tech Services Conditions

The Customer’s Account will stay active for a duration of 90 days from the last transaction or the date of Account activation. Customers will be able to recover the account by doing account reactivation within 365 days from deactivation.

In the event of a loss or failure of the customer’s number registered in the Autolink AI Tech platform, the customer must inform the company immediately through the Customer Care Live Chat Support on the Autolink AI Tech platform to suspend the service to prevent unauthorized use of Autolink AI Tech services. Such unauthorized activity includes, but is not limited to, fraud, money laundering, terrorism financing, blacklisting, etc.

By applying to the Autolink AI Tech platform, Customers are granting their full consent and authorization for Autolink AI Tech to request Customer’s data from any financial agency or any institution or any consumer reporting agency to access their financial records or other financial information to assess and determine the customer's eligibility.

Customers grant their full consent and authorization for Autolink AI Tech to request KYC personal information from ABSHER or any other institution to determine and evaluate the individual’s identity and legal capacity to commit themselves to the obligations stated in these Terms and Conditions.

“Autolink AI Tech”is not entitled to disclose any personal information, documents, or details of any activities in the Customer’s Account except when requested by a governmental entity specialized in combating fraud, money laundering, and financing of terrorism or with explicit consent from the Customer.

“Autolink AI Tech”may disclose personal data when disclosure is necessary in the following cases:

To ensure the protection of public health or safety, and/or to protect the life of a particular individual or individuals.
To carry out subsequent processing in a way that does not lead to the personal data owner or any other individual in particular.

The Customer shall comply with any instructions issued by Autolink AI Tech related to Autolink AI Tech Platform.

5. Suspension and Closure of Account and Services:

Autolink AI Tech Company reserves the right to suspend or discontinue Autolink AI Tech Platform Services and either wholly or partially, or to block, restrict, or terminate the Account or suspend the usage of any PIN code at its discretion at any time in the following cases:

1. In the event that Autolink AI Tech recognizes that the customer’s mobile phone or PIN code used to obtain Autolink AI Tech Services is being used contrary to what has been disclosed or for illegal activities.
2.In the event that any legal entity, competent regulatory or governmental authority, or similar authority initiates an investigation or takes regulatory, administrative, or executive actions against the customer, or any other actions that might damage Autolink AI Tech’s reputation.
3.In the event that the customer does not comply with the conditions, regulations, or relevant instructions for using Autolink AI Tech Services, including the usage terms.
4.In the event that the customer number used to register in the Autolink AI Tech platform has been lost or stolen, or if the PIN code has been improperly disclosed to another person.
5.In the event of receiving a request from the customer for account closure after settling all liabilities with Autolink AI Tech.
6.In the event of technical failure, modification, upgrade, change, relocation, repair, and/or maintenance due to any emergency or for any technical reasons.
7.In Case of suspected violation of the rules, regulations, guidelines, and directions of SAMA or for any violation of the Terms and Conditions mentioned herein.
8.“Autolink AI Tech ”reserves the right to close or suspend the customer's account at its discretion.

In addition, Autolink AI Tech assumes no liability to the customer for any loss, defect, or direct or indirect damages caused by any behavior or negligence of the customer's account status in the event of the closure or suspension of his account.

In the event that any defect in service operation falls within Autolink AI Tech’s responsibility for any reason, Autolink AI Tech will be committed to mitigate the impact of the damage to the Autolink AI Tech Platform, if any.

6. Security and Unauthorized Usage

Each Account has one PIN Code that the customer can use to access their account.

The customer shall be solely responsible for the confidentiality, safety, and security of their PIN Code and other credentials.

The customer shall be solely responsible for the consequences arising from disclosure of the PIN Code and/or the unauthorized use of the Autolink AI Tech platform and/or service, and the customer shall be responsible for any assigned third party, whether intentional or unintentional, acting on their behalf.

The Autolink AI Tech account will be blocked, and new credentials will be issued to the customer after validation in case of loss of the PIN code and/or mobile phone, placing it in an unsafe place, or exposing it to danger. communication through available resources in the "Autolink AI Tech "platform.

The Customer is responsible for protecting their mobile phone and its correct use and is also responsible for maintaining the secrecy of the PIN Code and all Autolink AI Tech Service transactions completed through the Autolink AI Tech Platform.

The Customer has the right to change the PIN Code through the service menu on Autolink AI Tech Platform or through other means. In any case, the Customer must identify themselves upon any Autolink AI Tech Service transaction by using his mobile phone and PIN Code.

The Customer is prohibited from disclosing the PIN Code to anyone, including the Customer Care employee or Customers Care Center.

7. Customer’s Obligations

The customer is not entitled to use Autolink AI Tech Services or the Autolink AI Tech platform for any purpose that may be construed as contrary or unacceptable to any applicable laws, SAMA regulations, guidelines, judicial statements, Autolink AI Tech policy, or public policy, or for any purpose that might negatively affect the reputation of Autolink AI Tech.

The customer shall inform Autolink AI Tech immediately upon discovering any illegal actions or activities related to the product or service provided.

The customer acknowledges responsibility not to share his personal or financial data or his account data or any information with any party other than “Autolink AI Tech”under any circumstances. The customer bears full responsibility for any activity that occurs through his account, in accordance with the regulations approved by the Central Bank of Saudi Arabia.

The Customer acknowledges and pledges that all information entered into Autolink AI Tech Platform or otherwise submitted to Autolink AI Tech Platform is correct, complete, and updated including personal information regarding the Account. When processing a transaction, Autolink AI Tech will rely on the registration information provided by the Customer.

The Customer acknowledges that any errors in the information, such as misidentification of the beneficiary(s), incorrect or inconsistent Account names and numbers, or misspellings, are their responsibility. Autolink AI Tech bears no liability for carrying out a transaction based on the inaccurate or incomplete information provided or entered by the Customer.

In particular, but not limited to, "Autolink AI Tech "services are intended for use in the Kingdom of Saudi Arabia, and therefore the customer is not allowed to use the service, in the following cases:

The activity results from or involves practices that fall within the offense, fraud or any other abnormal activity.
Use for the purpose of gambling, including placing bets or paying winnings.
which Autolink AI Tech determines is suspicious or may violate applicable law or regulation, including laws intended to detect and prevent Money Laundering, terrorist financing, human trafficking, fraud, or to enforce currency or exchange rate controls.

The customer is obligated to provide the necessary documents and information required for anti-fraud and anti-money laundering purposes and understands that non-compliance may result in the financing platform being rejected The customer agrees to share data for verification and evaluation, provided that his data will be used by the Autolink AI Tech platform and partner financiers to verify eligibility and evaluate financing platform. The customer also agrees to conduct identity verification using the “Nafath”platform to confirm his identity.

The customer agrees to abide by the terms, regulations, conditions, and privacy policy of Autolink AI Tech, in addition to any terms or regulations stipulated by Autolink AI Tech financier partners. The customer undertakes to use the Autolink AI Tech platform only for personal and non-commercial purposes, and not to resell or distribute any of the services or information provided through the Autolink AI Tech platforms.

The customer acknowledges his commitment to the terms and conditions and the privacy policy approved for the Autolink AI Tech platform, in addition to any regulations or instructions issued by the Central Bank of Saudi Arabia or financiers that partner with Autolink AI Tech.

The customer undertakes not to misuse Autolink AI Tech platform in any way that may lead to disabling or damaging the platform or affecting the performance of the services. The customer also refrains from using the platform for any illegal purposes or that conflict with public morals.”

The Customer agrees to only request a transaction that complies with these terms and conditions.

The Customer acknowledges to be cautious when granting a power of attorney to another person to carry out its financial transactions and is aware of the risks emanating from granting it.

The customer acknowledges accepting updates to the terms and conditions and agrees that the Autolink AI Tech reserves the right to update the terms and conditions from time to time, and the customer must review these updates and continue using the platform after any update is made, which is considered an implicit acceptance of these terms.

8. Data Protection and Confidentiality

Privacy of communication is subject to the terms granted by SAMA and its resolutions and circulars. The Customer agrees that in order to facilitate the provision of Autolink AI Tech Services, Autolink AI Tech may be required by law or otherwise to disclose any information or details about the Customer to any governmental authority or when disclosure is made with the written consent of the Customer.

By applying for the Autolink AI Tech Service, Customers shall grant their full consent and authorization for Autolink AI Tech to request Customer’s data from non-owner or process it for a purpose other than the one for which it was collected. In such cases the Customer’s personal data will not be recorded or stored in a form that makes it possible to identify the owner and know him directly or indirectly.

Where the non-owner is from a regulator or government agency then the above clause will not apply.

By applying to the Service provided by Autolink AI Tech, the Customer fully understands and acknowledges that the following minimum personal data shall be used for KYC and marketing purposes.

Name (KYC and Marketing)
National ID/ Iqama (KYC)
National Address (KYC)
Contact number (KYC and Marketing)
IBAN Account Number (KYC)
Credit Card number (KYC)

Except for Sensitive Data, Autolink AI Tech may process personal data for marketing purposes.

As per the regulation the following are considered to be sensitive data.

Relationship to Saudi Arabian Civil authorities
Credit Data

The “Autolink AI Tech”user graphics, brand names, logos, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements of Autolink AI Tech Services and Autolink AI Tech Platform provided by the Company (the "Materials") are protected by copyright, designs, patent, and trademark laws, international conventions, and other applicable intellectual property rights.

Personal and financial information of Customers can only be accessed and used by authorized employees.

The Customer has the following rights with respect to the Customer’s personal data:

The right to know, including effectively informing the customer of the legal or practical justification for the collection of his/her personal data, and the purpose thereof, and that his data shall not be subsequently processed in a manner incompatible with the purpose of collection or in circumstances other than those business purposes provided by Autolink AI Tech.
Customer’s right to have access to his/her personal data available to Autolink AI Tech, such access to be provided by Autolink AI Tech to this data including the ability to obtain a copy of the customers personal data in a clear format and conforming to the contents of the records, and without a fee.
Customers' right to request correction, completions, or updating of his/her personal data available to Autolink AI Tech.
Customers have the right to request the destruction of his/her personal data available to Autolink AI Tech, 10 years after the retention period of the Customer’s personal data in the Autolink AI Tech platform.

Autolink AI Tech ensures that customers' Autolink AI Tech service transactions and information remain secure and confidential by utilizing all reasonable measures.

Autolink AI Tech makes no warranty of any kind about the Autolink AI Tech Platform, the Autolink AI Tech Service, the system and the network or their function or performance, or for any loss or damage, whenever and whatsoever suffered or incurred by the Customer or by any other person resulting from or in connection with the use of Autolink AI Tech Services.

9. Disclaimer and Indemnity

The Autolink AI Tech Platform, the Autolink AI Tech Services, the materials on the Autolink AI Tech Platform, and any product or service obtained through Autolink AI Tech Platform are provided "as is"and without any kind of guarantee, either express or fully implied permissible under applicable law.

Autolink AI Tech and its affiliates, licensors, suppliers, advertisers, sponsors, and agents disclaim all warranties, express or implied, including, without limitation, implied warranties of title, non-infringement, accuracy, merchantability, and fitness for a particular purpose, and any warranties that may arise from course of dealing, course of performance, or usage of trade.

Autolink AI Tech and its affiliates, licensors, suppliers, advertisers, sponsors, and agents do not guarantee that your use of the Autolink AI Tech Platform and Services will be uninterrupted, error-free, or safe, and defects will be corrected, or that Autolink AI Tech Platform is free of viruses or other harmful components.

The customer acknowledges that they are responsible for obtaining and maintaining all mobile, hardware, and other equipment needed to access and use the Autolink AI Tech Platform and all charges related to it.

The customer assumes all responsibility and risk for using Autolink AI Tech Platform and Services and reliance thereon. No opinion, advice, or statement of Autolink AI Tech, its affiliates, licensors, suppliers, advertisers, sponsors, agents, members, or visitors, whether or not made on Autolink AI Tech Platform, shall create any warranty. The customer’s use of the Autolink AI Tech Platform and Services and all materials provided through the Autolink AI Tech Platform are entirely at their own risk.

Autolink AI Tech makes no express or implied warranty, guarantee, or undertaking regarding the Autolink AI Tech Services that are not expressly mentioned herein.

Autolink AI Tech shall not be responsible for any acts or omissions of any third-party including services which are not expressly authorized by Autolink AI Tech.

Autolink AI Tech shall not be liable to any person for any delays, loss of business, profit, revenue or goodwill, anticipated savings, damages, fees, costs, and expenses whatsoever arising, on Autolink AI Tech Services being unavailable/usage of the Autolink AI Tech Services or otherwise.

The customer agrees to indemnify, defend, and hold Autolink AI Tech and/or related parties harmless from all claims, losses, damages, liabilities, costs, and expenses, including and without limitation legal fees and expenses, arising out of or related to the use or misuse of Autolink AI Tech Platform and Services, for any violation of these Terms and Conditions, or any breach of the warranties, and covenants.

Autolink AI Tech does not assume any responsibilities arising from any complaint by the financing entities after the completion of the finance grant or the refusal of funding for any reason, nor does the company bear any dispute arising between any of the financing applicants and the financing entities.

10. Changes of Terms and Conditions

Autolink AI Tech has the right to make any changes to these terms and conditions at any time. In the event of any change, Autolink AI Tech shall notify its customers by guaranteed means of communication of any change in the terms and conditions at least 30 business days before the change in the terms and conditions takes effect. The updated copy of the Terms will be displayed on the Autolink AI Tech website.

In the event that the customer objects or disapproves of the change in terms and conditions, the customer must file his objection within (10) business days from receiving the notification of the changes in terms and conditions.

The customer’s continuous use of the Autolink AI Tech Services following changes to the Terms will be considered an acceptance of such changes.

The Terms herein shall be subject to the notifications/ guidelines issued by SAMA.

11. General Terms and Conditions

The Customer should inform Autolink AI Tech immediately of any changes to his/her personal information in the Registration process.

Any dispute with or complaint against any financial services provided through Autolink AI Tech Platform must be reported directly by the customer by sending an email to info@-----------.com.sa, and by direct support available on the platform or website. Autolink AI Tech has the right to investigate the allegation and determine in good faith, at its own discretion, to resolve any disagreements fairly and amicably.

Autolink AI Tech platform records shall be binding as conclusive evidence of the transactions carried out using Autolink AI Tech Services in any dispute.

Autolink AI Tech owns all copyrights, trademarks, and other intellectual copyrights in the

Materials, and the customer hereby agrees that he has no right to use or claim such rights.

The customer agrees to receive SMS messages from Autolink AI Tech through the mobile number mentioned in the registration request process.

These Terms (or any amended copy) are considered an agreement committing the Customer or his representatives to the terms and conditions stipulated herein.

These Terms may not be transferred or referred to any other person except the customer mentioned in the registration form.

All rights and reparations mentioned in this agreement are accumulative and do not exclude any rights or reparations stipulated by the law.

12. Applicable Law and Settlement of Disputes

The Agreement shall be subject to, construed and implemented in accordance with the laws, regulations, instructions, decrees and any other instruments having the force in the Kingdom of Saudi Arabia. In the event of any dispute or controversy arising between the First Party and the Second Party with regard to the implementation of the Contract which cannot be settled amicably, the matter in dispute shall be referred for final settlement to the competent Saudi court in the Kingdom of Saudi Arabia at the city of Riyadh.

13. Customer Consent

I hereby acknowledge that I have read the agreement and clearly understood the content, including the processing of personal data and the basic process of evaluating the customer for obtaining the services provided by Autolink AI Tech, and by agreeing to the above, I acknowledge and agree to the following:

By signing any form or document, it represents a confirmation and an approval of the form/document’s content.
Autolink AI Tech to be authorized to process my personal information in compliance with the regulatory requirements of the Region and for the purpose of the Autolink AI Tech processes required for the financing offers.
Autolink AI Tech to be authorized to access my personal information via ABSHER platform or any other institution.
Autolink AI Tech to be authorized to retain my personal data for a period of 10 years, upon completing this period I shall be given privilege to purge my data from all Autolink AI Tech records.
I understand that where the following applies my consent as a data owner shall not be applicable to the processing of data:
Autolink AI Tech to be authorized to access my financial records for credit record examination purposes via SIMAH.
Autolink AI Tech to be authorized to access my financial records for filing, updating credit information purposes via SIMAH.
I acknowledge that it is my responsibility to review my Account details and related notices promptly upon receipt of related notification.
I agree to pay Autolink AI Tech any outstanding credits, fees, or taxes that have been incurred on my Account.

I agree that only in the following cases shall my personal data be transferred outside the Kingdom or be disclosed to a party outside the Kingdom:

The party to which the personal data is disclosed has agreement with The Kingdom, or has interests to serve the Kingdom, or for other purposes as determined by the regulations.
The disclosure of the data does not prejudice the national security or the vital interests of the Kingdom of Saudi Arabia.
The party outside The Kingdom has incorporated Data Privacy laws similar to the Personal Data Protection Law (PDPL) followed in The Kingdom which is adopted by Autolink AI Tech.
Sharing of personal data is approved by SAMA.
I agree to be liable for any damages, costs, or termination of the Account incurred by my failure to acknowledge my account statements and related notices or my personal data and Autolink AI Tech shall inform me regarding the damages, costs or termination of account revocation.
I consent that Autolink AI Tech can display my name on the Autolink AI Tech Platform pages, on the welcome page prior to logging in and while I am using the Autolink AI Tech Platform
I agree to notify Autolink AI Tech in writing or by phone of any changes to my account information or other information that I have provided in connection with these terms.
I agree to provide my consent for Autolink AI Tech to send advertising or awareness materials.
I acknowledge that I have full legal capacity to approve this document and contract with Autolink AI Tech.

Commission

The client agrees to the entitlement of Autolink AI Tech Digital Brokerage Company (the 'Company') to a commission in exchange for the services and brokerage provided to them. The value or percentage of the commission shall vary depending on the type of financing product, the financing provider, and the nature of the service rendered.

The commission value or percentage, along with any related details, shall be disclosed to the client in the contract concluded with them prior to the completion of the financing acquisition procedures.

The Company shall be entitled to the commission for the financing product selected by the client and successfully obtained, in accordance with the applicable laws, regulations, and instructions.
